In regard to copyright infringement....

I have a photo of a flower with a painting's print behind it in the backgound of an English garden apartment.   I'm featuring the flower and really like the effect of the background, kind of real and surreal.  My dilemna is whether that is a problem for a card.  I can't even find the artist listed anywhere if I'm even reading the name correctly.  Artists get so creative with their names, like rock singers you can't even understand the words.  LOL  This is a quality framed, but mass produced print, nothing special I don't think.    
Anyway what's the rule on something like this?

My opinion only...
 
The simple fact that you stated it was a mass produced print causes concern for me in that it will in fact be very recognizable and could give you trouble.  If it were me I would not use it.  
 
What I would do is take my blending tools in Photoshop and swirl it around on the painting so that the pleasing colors were turned into an impressionistic painting still nicely framed that is no longer recognizable.   Roll Eyes

I agree with Doreen and Ernestine. As long as the print is obscured in some way, you should not have copyright issues. Her "swirling" suggestion is a good one. I am assuming that you had permission to photograph the apartment itself since it sounds like it might be recognisable too. You might want to check up further on copyright information at http://www.copyright.gov.

Thanks you two!
I was thinking that also, but I love the open Bird cage and the light through the window with the single rose in the foreground.  We get trapped by the surreal effect of love and the comfort it affords...blah, blah...blah!  LOL
I'll blur it beyond al rcognition then!   cry

Woops!  You three now!  What are you guys doing up so late?  LOL
The painting is of an English Decor apartment.  So that's the only concern.  Better safe than sorry so I'm blurring!
