Thanks Antoinette,

You posted some great questions that would be able to help alot of us who aren't really understanding how to fill out these forms. I'm still waiting to find out if there's someone willing to just overlook my form to make sure that I'm doing the right thing. I don't want to submit something that will most likely need corrections to be made later on...I can't afford to lose too much time trying and guessing to do this the right way.

So if there is anyone willing to help guide me through this thing...I will be eternally grateful. Please help!!! cry

Hi Antoinette,

No7 is optional, you can leave it blank.
No10, the way that I read it is if you are receiving a student grant in the USA but are claming your country’s treaty not to pay tax. You just need to put Netherlands in No9a and leave No10 blank, the USA will then withhold the tax agreed with your county if any.

I hope that makes sense embarrassed

, if not I am sure that someone else will have a go at explaining it.

If you are a non-USA based artist, you will have received an email on 17th December from Mike Fake who is the Chief Financial Officer of Big Dates/GCU. The following is an excerpt from his email:

"We need you to do this prior to the next payment of artist fees which is expected to by January 30, 2011. We cannot make any future payments to you without the W8-BEN. Once complete, please send the signed form back to us via email, FAX or US Mail.

    2694 Bishop Drive, Suite 211
    San Ramon, CA 94583

Attn: Mike Fake or Susan Tricca
Money paid to you for personal services for work you perform in your own country for a United States based company is treated differently and not subject to withholding. Your artist fees are not considered personal service income but considered royalties and thus are subject to withholding."

I didn't receive the email, which is why I didn't know where to send the completed form. I'm not surprised - my email provider loses more emails than it should, and it's not in the spam box either. Anyway, I saw this thread so that's okay.

I don't know if I must check the box in Part III line 11 - I do not understand this part =

"Part III - Notional Principal Contracts
11 - I have provided or will provide a statement that identifies those notional principal contracts from which the income is not effectively connected with the conduct of a trade or business in the United States. I agree to update this statement as required."

In Instructions for Form W-8BEN is written =
"If you check this box, you must provide the withholding agent with the required statement for income from a notional principal contract that is to be treated as income not effectively connected with the conduct of a trade or business in the United States. You should update this statement as often as necessary. A new Form W-8BEN is not required for each update provided the form
otherwise remains valid."

Did you checked this box?

If any part of your company does not work in America then you do not need to tick the box. GCU is not classed as part of your company.

Our post was delayed nearly 3 weeks due to snow, I know a lot of stuff sent to me before Christmas still hasn`t arrived, as well as some stuff I sent before Christmas, and that`s just in UK. I need to know if the form has been received! Karen

I only sent in a digital copy. KAren if you could scan the form and send it in, that would ensure they get it.
